Stalprofil withdrew from signing the contract with Polska Spółka Gazownictwa for the construction of the gas pipeline

Stalprofil has withdrawn from signing the contract with Polska Spóka Gazownictwa for the construction of the DN 400 gas pipeline from Dąbrowa Górnicza – Szopienice, the company said in a statement. The reason is the occurrence of factors beyond the control of the contractor that arose after the submission of the offer.

The bid by Stalprofil was for a total value of 27.3 million PLN.

The Company has informed that factors which the Contractor deems to be Force Majeure in particular include: Cancellation of bids by subcontractors in specialized works, due to circumstances beyond the control of these entities, occurring after the date of submission. Bidding limited possibilities for the procurement of materials necessary for the implementation of the contract, on the specified dates and prices, mainly due to the effects of Russian aggression against Ukraine, including imposed economic sanctions; The lengthy course of contract award procedures which, in combination with the foregoing factors, makes it virtually impossible to perform the contract within the time limits planned by the contracting authority.

Stalprofil’s offer was secured with a bail of 250 thousand. zloty. As a result of withdrawing from the conclusion of the contract, the contracting authority retained the bid security.

“The Contractor, realizing that the reason for withdrawing from the signing of the Contract is the occurrence of force majeure events, intends to request the return of the bid guarantee from the Contracting Authority” – he wrote in the announcement. (PAP Biznes)
