The Second Amendment to the Private Law amending the Law on Assistance to Ukrainian Citizens in Relation to an Armed Conflict in the Territory of that country passes quickly through Parliament. It provides for several changes to facilitate procedures for the presence of up to 2 million refugees in Poland from the Russian aggression against Ukraine.

One of the most important changes is the extension from 60 to 90 days of the period in which Ukrainians must register in our PESEL system after coming to Poland. Local governments will also be able to employ Ukrainians in auxiliary and service positions (except for jobs where work involves direct or indirect participation in the exercise of public power). With this employment, knowledge of the Polish language will not be required.

The amendment also creates a system for appealing decisions to grant cash benefit to support refugees in Poland. Surprisingly, the Administrative Procedures Law does not apply to these procedures. Everything indicates that these cases will be referred to the civil courts, where the applicant will argue with the municipality whether he is entitled to this benefit and in what amount. Therefore, these processes are expected to continue for years. The government may want to dissuade potential applicants from filing such lawsuits.

After the changes, entrepreneurs affected by the Russian aggression against Ukraine will be able to count on support from the Gospodarstwa Krajowego Bank. According to the amendment, a Crisis Guarantee Fund will be established in it, which will provide them with guarantees and guarantees for loans granted or other obligations. The BGK guarantee will cover 80 percent. The amount of the loan, and in particularly justified cases, can be granted at a rate of up to 90 percent. The warranty period is a maximum of six years, not less than three months.

The private law also shows that central offices, including ZUS, KRUS, Tax Office, National Labor Inspectorate and Border Guard, will exchange information about the employment of Ukrainians in Poland. Not only in full-time jobs or assignments, but also in specific employment contracts. The purpose of adding new provisions is to provide the relevant minister for labor affairs and control institutions with updated information that will enable an assessment of the number of Ukrainian citizens who perform work in accordance with the provisions of the law, as well as to direct those who are entrusted with the examination of work performance for compliance with the law, in particular with regard to the minimum wage for work Occupational health and safety. ZUS and KRUS will provide inspection services with data on whether a Ukrainian citizen is covered by social insurance, respectively, or upon notification of a specific employment contract or farmers’ social insurance.
