Frankfurt/Washington (dpa-AFX) – Dialysis provider Davita has suffered a defeat in the US Supreme Court in a dispute over the amount of compensation for some dialysis patients. The majority of the nine US Supreme Court justices sided with a hospital in Ohio, and therefore against US rival FMC, in the dispute over the company’s health insurance design, according to court documents published Tuesday.
Accordingly, the insurance plan does not harm patients with end-stage kidney disease by paying lower dialysis fees than other treatments. Davita sued the hospital for paying the lowest reimbursement rate for dialysis treatments. The ruling could be a reference to similarly designed private health insurance companies from other companies. Shares of dialysis service providers have come under severe pressure.
