Adam Botner. The ombudsman comments on the outcome of the constitutional tribunal

On Thursday, the Constitutional Tribunal, headed by Julia Prozypska, ruled that the provision allowing the ombudsman to act after the end of his term was unconstitutional. The rule – Przyłębska said – “This decision stops applying three months after its publication in the Journal of Law”.

The verdict was published in the Journal of Law a few hours after the decision was announced.

Botner spoke about the possible consequences of Thursday’s verdict on “Tak Tease” on TVN24.

– In the coming weeks, even for three months, I will have to continue to do the work of the Ombudsman, probably with some limitations, because the justification points out that some actions may be called into question –

“But this verdict is not really about how long I have to do these tasks, but about whether or not we get an independent ombudsman right,” he continued.

However, Potner said the ruling would “probably not be as significant from a constitutional point of view” if politicians reconcile a candidate with the Senate and appoint him within the next three months. “.

– And I think the whole world will see this, how Poland copes with it, because today this position has already been published by Human Rights Watch and the Commissioner for Human Rights [Rady Europy – przyp. red.] Vera Jurova, vice president of the European Commission, also commented – he added.

Speaking further on the circumstances under which the decision of the Constitutional Tribunal was given, Botner said, “We are dealing with the handling of the tribunal,” recalling that there were changes in it.

One of the judges is a former Bais MP. He also mentioned that Stanislaw Pyotrovich. – When you follow the statements of Stanislaw Pyotrovich, it is difficult to get the impression that he can be completely impartial in matters that indirectly concern me, especially since he was chairman of the Parliamentary Committee on Justice and Human Rights.

He said there were no legal tools to appeal against the decision of the Constitutional Tribunal.

Botner also spoke about the specifics of his activity in the ombudsman’s office. When asked what the complaints were mainly about, he replied that they were mostly from prisoners and that this was a standard that had been maintained for many years. – There have been many complaints about the actions of the courts, the prosecutor’s office and the police, especially in recent months, as the police have repeatedly abused their powers and used the pretext of epidemics to enter the realm of civil relations – the ombudsman continued.

He also said that there have been numerous complaints about access to various social benefits.

However, he pointed out that “last year was primarily an epidemic and all the issues related to it, including the restriction of electoral rights.” – Just because we discussed these unfortunate correspondence elections exactly a year ago and then remember that the elections were organized in a better way, but this does not mean that the election rights were not violated – he noted.

When asked about the evaluation of the work performed, Botner replied: – Despite these difficult times, it seems to me that my performance has been very good.
