The Windhorst investor is said to have pledged a stake in Hertha

The Windhorst investor is said to have pledged a stake in Hertha

There is no peace at Hertha BSC: After investor Lars Windhorst caused a stir with a TV interview, things are likely to get worse. He is said to have mortgaged his stakes in the capital club.

Lars Windhorst wanted to make Hertha FC a “big city club,” as he put it himself. But a lot has happened in the capital club since he joined in 2019. Now Business Insider reports that a notary called Hertha last weekend and announced in an email that Dutch company Bell Investments BV would be auctioned off. This is a subsidiary of Tennor Holding BV group of companies which owns equity in the capital club. If the company is auctioned, the shares in the Bundesliga club will also be auctioned and Lars Windhorst will not be an investor in the club.

As the medium further indicates, I telephoned the same notary, who announced the auction to the highest bidder, thus possibly also referring to a judgment of the District Court in Amsterdam on 1 April 2021 with file number C/13/689706.

Windhorst may not be able to repay loans in 2020

Now it gets complicated: Lars Windhorst was in an awkward position in July 2020 and had financial concerns. It is alleged that “S4 Limited” granted the investor from Hertha BSC a short-term loan of 25 million euros. According to the loan agreement, it was required to be repaid within 30 days – plus 2 million euros in interest. But this case is exactly what should have happened, and for this, in accordance with Article 4.2 of the contract between “S4 Limited” and Tennor, the Peil Investment pledge must apply.

According to the judgment of the District Court in Amsterdam, “Tenor […] Failed to pay the loan amount and interest by August 31, 2020. On September 10, 2020, Tennor paid €10 million to S4 Limited. The company then attempted to take legal action to enforce the remaining lawsuit against Tennor. According to Business Insider, Rechtsbank Amsterdam then decided on September 1, 2021 on behalf of the King that the responsible notary should organize and carry out the sale of the foreclosure to Bell Investments. In addition , the Amsterdam District Court is said to have assured the mediator that the ruling is final and there can be no appeal.

A Windhurst spokesperson is said to have denied this pledge

So the notary has now sent an email to Hertha to inquire about the value of Peil Investment’s stock. Therefore, the compulsory auction could potentially be stopped at any time by an out-of-court settlement.

A Windhorst spokesperson is said to have initially denied undertaking the medium and later wrote that the “process you describe” was thus “inconsistent with current realities” but was “done”. Allegedly, the notary didn’t say anything to Business Insider about completing the process. Accordingly, the online medium from the club environment claims to have learned that the room’s stock pledge may have been unfaithful.
